Defamation is a criminal offense in Cuba and is punishable between three months and one year’s imprisonment (Penal Code, Article 318). However, it is noted that most of the criminal prosecution for defamation in Cuba refer to the defamation of public institutions, organizations, national heroes and martyrs (Article 204) which is often used in conjunction with other provisions to curb freedom of expression by preventing public debate and criticism of the authorities and government policies.
